摘 要

随着互联网技术的飞速发展和智能设备的成熟和普及，网络直播作为新兴的文化产业应运而生并且迅速发展成为人民娱乐生活和市场经济的重要部分。然而，网络直播在丰富人们生活和创造巨大经济价值背后随之而来的是各种乱象问题的发生，主要表现在直播内容低俗化和违法侵权行为的泛滥。本文将分析具体网络直播失范案例并探究其原因。从行政规制角度出发，针对我国目前规制现状，总结出我国法律法规不完善、规制主体多元混乱、规制力度不足和行业自律效果不佳等问题。研究日本、韩国、德国和美国等国家网络直播规制成熟先进经验并结合我国国情，提出首先需要健全我国网络直播法律体系，重点在于未成年人网络环境保护和网络实名制推行。还需明确规制主体，优化行政规制模式、引导行业自律，鼓励群众监督以及提升网络直播规制技术等完善对策，从而促进我国网络直播产业的健康发展，完善我国网络直播规制手段。

Research on the Administrative Regulation of Network Live Broadcasting in China

Abstract

With the rapid development of Internet technology and the maturity and popularization of smart devices, webcasting has emerged as an emerging cultural industry and has rapidly developed into an important part of people's entertainment life and market economy.However, after enriching people's lives and creating huge economic value, the network live broadcast is accompanied by various chaos problems, mainly manifested in the vulgarization of the live broadcast content and the proliferation of violations.This paper will analyze the specific cases of the anomie of live network and explore the reasons.From the perspective of administrative regulation, according to China's current regulatory situation, it analyzes the problems of imperfect laws and regulations, diversified and disordered regulatory bodies, insufficient regulatory strength, and poor industry self-regulation.Based on the study of the mature and advanced experience in the regulation of live network in Japan, South Korea, Germany and the United States, and combined with the national conditions of our country, it is proposed that the legal system of online live broadcast in China needs to be improved first, focusing on the implementation of minors' online environmental protection and online real-name system.It is also necessary to clarify the main body of regulation, optimize the administrative regulation mode, guide the industry to self-discipline, encourage the masses to supervise and improve the network live broadcasting regulation technology and other perfect countermeasures, so as to promote the healthy development of China's network live broadcasting industry and improve China's network live broadcasting regulation means.
