社会保险纠纷的性质与处理毕业论文

摘 要

我国于2010年实施的《社会保险法》旨在社会保险领域覆盖全民,但其中涉及社会保险纠纷的处理非常少。现实情况下,社会保险纠纷最常见的情形有社会保险费补充缴纳纠纷和赔偿纠纷这两种情况。目前状态下,一般都当做劳动争议性质来处理,然而在现实中出现的问题则越来越多。现今,国内学者主流观点是应该对社会保险纠纷的多种情形加以区分,区分不同的属性,即行政争议属性、劳动争议属性。当前法律也规定了多种处理方式,但多种方式之间并未形成一种良性互动。本文主要研究社会保险纠纷的性质,以及探讨其处理方式,在研究多位学者的著作、论文,以及指导老师的指导之下,提出自己的观点。

The nature of social insurance disputes and processing mode

Abstract

China in 2010 the implementation of the "social insurance law" to the field of social insurance coverage, but the treatment which involves the social insurance disputes is very small, namely the social insurance tax disputes should be established for the nature of the administrative dispute, dispute of compensation for social insurance should be established for the nature of labor dispute. At present, in the application, generally as a labor dispute processing, so the problem is outstanding. Nowadays, Chinese scholars should be more mainstream view is to distinguish social insurance disputes, distinguish different attributes, namely administrative dispute, labor dispute attribute attribute. This paper mainly studies the nature of social insurance disputes, and to explore its treatment method, in the study of many scholars, this paper works, under the guidance of teachers and, combined with China's specific national conditions, to China's current mode of analysis, and put forward their views.
