我国旅游市场诚信危机的法律分析毕业论文

摘 要

我国旅游市场正在遭遇诚信危机。从法律角度探讨诚信危机的产生原因,有利于以法律分析得出的结论为依据对这一问题提出针对性的法律规制意见。首先,研究我国旅游市场的历史与发展。在市场经济的发展需求和国家政策的积极扶持下,我国旅游市场目前处于一个对其发展较为有利的社会环境和经济环境,但与此同时,失信问题的不断暴露,扰乱了我国旅游市场的交易秩序,使其陷入了诚信危机。其次,探讨旅游市场主体不诚信行为表现。旅游服务提供者常有价格欺诈、打出虚假广告而后降低服务标准等违约行为;旅游监管者则由于地方保护等原因,监管不到位,或故意放宽监管标准等。再次,从法律各环节分析我国旅游市场诚信危机的产生原因。立法方面,由于我国旅游法律法规内容不够全面、较为抽象从而缺乏可操作性,而缺少精神损害赔偿有关规定以及惩罚性赔偿条款适用主体的单一、适用条件的苛刻导致了违法后果对不诚信行为者的威慑力不强;司法方面,繁琐耗时的诉讼程序和举证困难使消费者不愿拿起法律武器维护自身权益,间接助长了不诚信经营者的气焰;执法不严使相关法律法规得不到落实,旅游纠纷得不到合理解决。最后,在以上研究的基础上,对我国旅游市场诚信危机的法律规制提出建议。

Abstract

China's tourism market is suffering from the credit crisis. From a legal point of view to consider the causes of the credit crisis, Is conducive to the conclusion drawn from the legal analysis as the basis for the issue of the legal regulation opinions.First of all, researchthe history and development of China's tourism market. With the development of market economy and the positive support of national policy, China's tourism market is currently in a favorable social environment and economic environment.But at the same time, dishonest problem has been exposed, The trading order of the tourism market in our country has been disturbed, so that it has been caught in the credit crisis.Secondly, to explore the behavior of the main body of the tourism market’ dishonest behavior.Travel service providers often implement price fraud, or reduce the standard of service after making false advertising.Due to local protection and other reasons, the supervision of travel regulators are not in place, or deliberately relaxed regulatory standards, etc.Again, from the legal aspects of the analysis of the causes of the credit crisis of China's tourism market.In legislation, the content of tourism laws and regulations in China is not comprehensive and abstract, so it is short of maneuverability.In addition, the lack of compensation for mental damage, punitive damages provisions of the subject is too single, the applicable conditions are more stringent, resulting in the illegal consequences of the lack of integrity of the deterrent force is not enough.From the perspective of judicial, tedious and time-consuming procedure and the difficulties of proof leads to consumers are reluctant to pick up the legal weapons to protect their own rights and interests, indirectly contributed to the arrogance of the dishonest operators;Execute the law lax,bring about that  the relevant laws and regulations can not be implemented, tourism disputes can not be reasonably resolved.Finally, on the basis of the above research, we put forward suggestions on the legal regulation of the credit crisis of China's tourism market.
